Senator Rosilicie Ochoa Bogh announced on Apr. 16 a three-bill legislative package designed to improve the implementation of the Western Joshua Tree Conservation Act while ensuring that residents and public agencies maintain access to essential services.

The proposed legislation, which includes Senate Bill 1061, Senate Bill 1062, and Senate Bill 1063, seeks to clarify existing law, streamline permitting processes, and reduce unintended burdens on homeowners, local agencies, and rural communities.

“This bill package brings balance back to the law by clarifying definitions, streamlining compliance, and ensuring that families are not blocked from accessing basic, life-sustaining services like water, electricity, and sewer,” said Senator Ochoa Bogh.

The Western Joshua tree is native to California’s high desert. According to Senator Ochoa Bogh’s office, current implementation of conservation measures has created challenges for residents and agencies conducting routine maintenance or infrastructure projects needed for safe communities.

SB 1061 aims to refine the definition of “take” in relation to the plant species by clarifying that unintentional or accidental death of a Western Joshua tree does not constitute a violation. It also exempts certain relocations within commonly owned parcels from permitting requirements. SB 1062 would allow the California Department of Fish and Wildlife greater flexibility in establishing permit conditions for projects related to vital utilities such as water or electricity. SB 1063 proposes an expedited permitting process for homeowners installing or repairing critical infrastructure without requiring fees or complex mitigation steps.

The bills are intended to align state regulations with practical needs while maintaining protections for the species.
